These terms apply to CubePOS websites, applications, dashboards, POS tools, tenant portals, billing services, and related support services.

If there is any inconsistency, ambiguity, or dispute between translated versions, the Traditional Chinese version shall prevail.

Terms & Conditions

These terms explain subscriptions, payments, access, responsibilities, and support while using CubePOS.

Acceptance of terms

  • By accessing or using CubePOS, the customer confirms that they have read, understood, accepted, and agreed to these terms.
  • The person creating or managing a shop account confirms that they have authority to bind the shop, company, or organisation they represent.
  • If the customer does not agree to these terms, the customer should not continue using CubePOS.

Subscription and billing

  • Plans are billed monthly or yearly according to the selected billing cycle.
  • A shop remains active while the subscription is active or within any allowed grace period.
  • If payment is overdue, CubePOS may place the shop into grace, expired, or suspended status.

Late payment and reactivation

  • Expired shops within the grace period can renew without late fee.
  • Suspended shops renewing monthly may have late fee applied according to the selected plan setting.
  • Suspended shops renewing yearly have late fee waived.
  • Admin verifies payment proof before reactivating the shop.

Plan changes

  • Expired or suspended shops may renew with the same plan or upgrade plan.
  • Downgrade is available only when current usage fits the lower plan limits.
  • Active upgrades may require prorated payment before extra limits become available.
  • Active downgrades are normally scheduled for the next billing cycle.

Cancellation and refunds

  • Customers may request cancellation through support or account channels provided by CubePOS.
  • Paid fees are normally non-refundable unless required by law or agreed in writing.
  • CubePOS may refuse renewal or suspend access for abuse, unpaid fees, or serious policy breach.

Limited licence

  • CubePOS grants customers a limited, non-exclusive, non-transferable right to access and use the service during the active subscription period.
  • Customers may not copy, resell, sublicense, reverse engineer, or misuse CubePOS except where expressly permitted in writing.
  • CubePOS may transfer, assign, or delegate its rights and obligations where permitted by applicable law.

Intellectual property

  • CubePOS software, design, workflow, documentation, branding, and platform materials remain the property of CubePOS or its licensors.
  • Customers remain responsible for product photos, descriptions, logos, uploads, imports, and other content they provide.
  • Customer content must not infringe trademark, copyright, privacy, trade secret, or other rights of any third party.

Disclaimers and limitation

  • CubePOS is provided on an as-is and as-available basis to the fullest extent permitted by law.
  • CubePOS does not guarantee that the service will be uninterrupted, error-free, or suitable for every customer purpose.
  • Customers are responsible for proper use of their accounts, devices, imports, exports, staff actions, and tenant actions. Data loss or service issues may occur because of user misuse, device problems, network interruption, server incidents, platform incidents, third-party service issues, or other events outside CubePOS control.
  • To the fullest extent permitted by law, CubePOS is not liable or responsible for data loss, business interruption, or losses caused by user misuse, customer-side actions, server incidents, platform incidents, third-party service issues, or events outside CubePOS control.
  • To the fullest extent permitted by law, CubePOS is not liable for indirect loss, loss of profit, loss of business, loss of data, or consequential damages.

Disputes

  • These terms are governed by the laws of the Hong Kong Special Administrative Region.
  • The parties should first attempt to resolve disputes in good faith through communication and support channels.
  • If any dispute arises, CubePOS may investigate according to the specific circumstances, and CubePOS has the right to make the final decision.
  • If any provision is invalid or unenforceable, the remaining provisions continue to apply.

Privacy Policy

This policy explains what data CubePOS handles and how it is used to provide shop, POS, tenant, billing, and support services.

Information we collect

  • Account information such as name, email, phone number, company name, and login details.
  • Shop operation data such as products, barcodes, cells, tenants, sales, rent records, payouts, and reports.
  • Billing information such as selected plan, payment proof, renewal history, and subscription status.
  • Technical information such as IP address, browser/device information, language preference, and security logs.

Cookies and technical data

  • CubePOS may use cookies, local storage, session identifiers, device data, and server logs to keep users signed in, secure accounts, remember preferences, and improve reliability.
  • Users may adjust browser settings, but some service features may not work properly if cookies or storage are disabled.
  • Crash reports, performance logs, and security events may be processed to diagnose errors and protect the service.

How we use information

  • Provide POS, inventory, tenant portal, reporting, billing, notification, and support functions.
  • Verify payments, prevent trial abuse, protect accounts, and investigate service issues.
  • Improve product reliability, onboarding, performance, and customer support.

Sharing and processors

  • We do not sell customer shop data.
  • CubePOS will not access customer shop operation data unless the shop owner gives CubePOS permission to help investigate, troubleshoot, or fix a problem.
  • We may use trusted service providers for hosting, payment processing, email, notifications, analytics, backups, and support.
  • We may disclose information when required by law, regulation, court order, or to protect CubePOS, customers, or users.

Customer rights

  • Subject to applicable law, users may request access to, correction of, a copy of, restriction of, or deletion of their personal data.
  • Some records may be retained where required for security, accounting, legal compliance, dispute handling, backup integrity, or legitimate business needs.
  • Withdrawing consent or requesting deletion may limit or prevent continued use of CubePOS services.

Retention and security

  • Shop data is retained while the account is active and during normal billing or recovery follow-up.
  • Backups, logs, and billing records may remain for security, accounting, or legal reasons.
  • CubePOS uses reasonable technical and operational safeguards, but no system can be guaranteed completely secure.

Policy updates

  • CubePOS may update this Privacy Policy to reflect legal, operational, technical, or product changes.
  • Material changes may be communicated through the website, dashboard, email, support channel, or other reasonable method.
  • Continued use of CubePOS after an update means the updated policy applies.

Terms of Use

These usage rules help protect shop owners, staff, tenants, customers, and platform reliability.

Account responsibility

  • The shop owner is responsible for staff accounts, tenant accounts, permissions, passwords, and activity under the shop.
  • Users must keep login details private and notify CubePOS if account access may be compromised.
  • Staff and tenants should receive only the access needed for their role.

Acceptable use

  • Do not use CubePOS for unlawful goods, fraudulent sales, misleading records, harassment, malware, or unauthorized access.
  • Do not overload, scrape, reverse engineer, bypass limits, or interfere with platform security.
  • Imported and uploaded content must be accurate and must not infringe rights of others.

Service suspension

  • CubePOS may suspend, restrict, or terminate access if a customer breaches these terms, creates security risk, misuses the service, or fails to pay applicable fees.
  • CubePOS may preserve or disclose records when reasonably necessary for legal compliance, safety, fraud prevention, service operation, or protection of rights.
  • CubePOS may modify, pause, or discontinue features when needed for maintenance, security, compliance, or product improvement.

POS and business records

  • Customers are responsible for checking sales, tax, accounting, payout, inventory, and rent records before relying on them.
  • Exports and reports are tools for operation, not professional accounting, tax, or legal advice.
  • Users should keep independent records where required by business or legal obligations.

Third-party services

  • Third-party services may be governed by their own terms and privacy policies.
  • CubePOS is not responsible for third-party websites, products, policies, actions, or service outages outside CubePOS control.

Service changes

  • CubePOS may update features, plans, limits, pricing, integrations, or policies as the service improves.
  • Important changes will be communicated through reasonable channels such as the website, dashboard, email, or support messages.
  • Continued use after changes means the updated terms apply.
